<초록>

본 연구는 인구고령화에 대비해 시대적 변화에 맞는 노인복지법 전면개정의 방향성을 탐색해 보고자 하는 목적으로 이루어졌다. 이를 위해 1981년 제정되어 수십 차례개정을 거친 현행 노인복지법과 2020년 기동민 의원에 의해 발의되었던 노인복지법전면개정(안)의 내용과 문제점을 분석해 보고, 그 개정 방향을 제시해 보고자 한다. 문제점은 주로 노인복지법의 법적 지위 및 기본 철학, 법률 구성의 체계성, 법률 각영역의 쟁점, 그리고, 법 적용대상 및 새로운 시대상의 반영 등을 중심으로 분석해 보았다. 현행 노인복지법은 노인복지기본법으로서의 위상이 분명하지 않고, 1981년 법제정이후 부분 개정만이 이루어져 법률의 구성이 체계적이지 못하며, 새로운 시대상을 반영하지 못하고 있다. 2020년 전면개정(안)은 노인복지기본법으로서의 위상을 갖추고자 하였고, 법률 구성도 체계적으로 제안되었다. 그러나, 법의 기본철학에서 노인을 여전히 보호의 대상으로서 규정하고 있고, 새로운 시대상을 반영하지 못하는 문제가 나타났다. 이러한 분석결과를 토대로 향후 노인복지법이 기본법으로서 전면개정되어야 할 방향을 제시하였다.

This study was conducted with the aim of exploring the direction for a full revision of the Welfare of Senior Citizens Act to reflect the societal changes in response to population aging. The current Welfare of Senior Citizens Act, which was enacted in 1981 and has undergone numerous partial amendments, and the 2020 full amendment proposal introduced by Assemblyman Ki Dong-min were analyzed to identify their issues and propose directions for the future revision. The analysis focused primarily on the legal status and foundational philosophy of the Welfare of Senior Citizens Act, the systematic structure of the law, issues in each legal sub-domain, as well as the scope of beneficiaries under the law and its reflection of the changing society. The current Welfare of Senior Citizens Act does not clearly establish itself as a fundamental law on welfare of older adults, and its composition is not systematic due to the series of partial amendments since its enactment in 1981, failing to reflect new societal changes. The 2020 full revision proposal aimed to establish the legal status as a fundamental law on welfare of older adults and proposed a systematic legal structure. However, the proposal still defined older people primarily as subjects of protection and did not sufficiently reflect the evolving societal landscape. Based on the findings, this study proposes the direction in which the Welfare of Senior Citizens Act should be fully revised as a fundamental law in the near future.
